Floods of tears

QUESTION: My apartment was flooded when a guest left a tap on just before we went out. I received a call from my rental agent informing me there was water dripping into the unit below and that they had called a plumber.

My contents insurance paid for my damaged property but my insurers would not cover the carpet cleaning as they said that would be covered by the landlord insurance.

The rental agent has asked me to pay $300 for the landlord insurance “excess” and says I have to pay the plumber’s bill of $70. Am I legally required to pay? – Mike2000 via Forum.

ANSWER: You are responsible for your guests and for any damage they may cause. If you weren’t insured, you’d have to pay the whole amount. If you feel your insurer is being unfair, take it up with them.

If you don’t pay, your landlord can apply to the CTTT for compensation or, at the end of your lease (which may come sooner than you hope) to take the money out of your bond. I’d be calling the person who left the tap on, asking what they plan to do about it.
