Recently we experienced a water leak from the ensuite shower into the bathroom floor which caused the vanity to swell and pull away from the wall which is a shared wall with another lot (concrete structure)
I contacted the Strata insurance company and they inspected and approved the claim for the vanity to be replaced. I sent this onto the owners’ corporation as there is an excess of $1000.00
The OC has advised that I will be responsible for the $1000.00 excess as they have a by-law as follows:-Special By-law 116.3(a) “You are responsible for any insurance excess that we may have paid on your behalf towards the settlement of a claim of damage affecting only your Lot property.”, she should be liable for the $1000 excess
As the vanity unit is attached to a wall that is shared with our neighbours lot, would this not constitute that is a common wall and the responsibility of the strata to pay the excess?
