      I would like thoughts on the following parts of the rules of a strata for an apartment I am looking at in Melbourne.

       

      I am looking at getting a dog, but I am concerned that the rules regarding dogs are more restrictive (under Amendments) than the standard rules you would expect.

       

      I am wondering what the rules in the amendment mean in practise.

       

      For example the rule of a dog on common property, does this mean you need to carry the dog over the common property ? It can’t be on a lead ?

       

      What does it mean regarding dog excrement ?

       

      Your advice would be much appreciated.

       

      3.1 Use of common property

       

      (4) If the owners corporation has resolved that an animal is a danger or is causing a nuisance to

      the common property, it must give reasonable notice of this resolution to the owner or occupier who

      is keeping the animal.

      (5) An owner or occupier of a lot who is keeping an animal that is the subject of a notice under

      subrule (4) must remove that animal.

      (6) Subrules (4) and (5) do not apply to an animal that assists a person with an impairment or disability.

       

      Amendment to Rules

       

      3. Animals

       

      A Member must not, and must ensure that the Occupier of a Member’s Lot does not:

       

      (a) keep any animal on any balcony, patio or garden area except when accompanied by the Occupier and then not in a manner to cause a nuisance to any other Occupier;

       

      (b) exercise any animals on Common Property or allow any animal to roam freely on Common Property;

       

      (c) allow any animal excrement or animal debris to build up run-off or affect in any unclean,unsafe or unhygienic manner any Common Property, Lot or part thereof; and

       

      (d) keep, mind or allow any more than one (1) dog and/or (1) cat on the Common Property or Lot without the prior written consent of the Owners Corporation or the Owners Corporation committee and then only upon the terms of such consent.

      Firstly, lucky you to have found an unit block that allows pets. I do hope you are adopting, not shopping for your new dog.

      The amendments seems pretty clear to me.

      (a) is designed to stop irresponsible people locking dogs onto the balcony all day while they are out where the dog will bark and annoy others.

      (b) means don’t let your dog wander around on common property. Of course you can walk across common property with the dog on a lead. When your dog is on a lead it’s within your control. If your unit block has a large common property area where you hoped to run your dog around, looks like that’s off limits unless you keep your dog on a lead.

      (c) means pick up your dog’s poo. Not a hard one to understand. And if your dog is pooing on your balcony, don’t hose it off where it will run onto someone else’s balcony. And if it poos on common property eg the front garden, pick up the poo. as a pet owner you are going to get very used very quickly to picking up poo.
