    My unit has mould infestation on furniture, some clothes following the installation of a watering system for a new garden which is on the eastern bedroom wall of my garden unit.

    Strata manager says damp is covered by them but not mould.  This seems grossly unfair to me as where I live (Sydney) has been in drought for many months and I have never experienced mould in any other place where I have lived.

    How is it determined who is responsible for payment to remove mould?

    The owners corporation is liable for the consequences of its actions – whether it is failure to repair or the installation of a watering system without the necessary protection.

    You are affected by the consequences of the OC’s actions and the OC must rectify the cause and if necessary compensate you.

    The SM is splitting hairs in saying the issue is damp rather than mould, but if there is mould, then there is almost certainly damp there to feed it.

    You can demonstrate damp by taking readings with a damp meter  – not expensive and obtainable from Bunnings.

    Or you can just say to the strata manager, “how about I take the owners corp to NCAT to force them to fix this, and you to Fair Trading for incompetence, while I’m at it?”

    Too many strata managers see their job as being to protect the committee by minimising spending at some individual owners’ expense, including their health. If the strata manager won’t budge, talk to a lawyer (click on the ad at the top of the page) or Flat Chat’s friends at StrataAnswers.
